By accessing this website or placing an order with Grey Legal Services (“Grey Legal Services,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions (“Terms”).
1. Scope of Services
Grey Legal Services provides professional service of process and related support services, including but not limited to service attempts, document handling, skip tracing, stakeouts, and related field services, as ordered through our website or other approved channels.
Grey Legal Services does not provide legal advice, and use of our services does not create an attorney-client relationship.
2. Service Area & Outsourcing
Grey Legal Services primarily services orders within its designated service areas, which are published on our website and may be updated from time to time.
If an order is determined to be outside of our normal service area, Grey Legal Services may, at its discretion:

Accept the order with an additional out-of-area fee; and/or
-
Assign, subcontract, or outsource the service to a licensed third-party process server or service provider.
By placing an order, the client expressly authorizes Grey Legal Services to outsource or subcontract service of process when necessary to complete the service, without additional notice, provided the service is performed by a qualified professional.
Grey Legal Services remains responsible for coordination of the order but does not guarantee the methods, timing, or outcomes of third-party providers beyond reasonable professional standards.
3. Client Responsibilities
The client is solely responsible for providing accurate, complete, and lawful information, including but not limited to correct names, addresses, documents, and instructions.
Grey Legal Services is not responsible for delays, failed service, or additional costs resulting from inaccurate, incomplete, outdated, or misleading information provided by the client.
4. Nature of Service / No Guarantee
Service of process is an attempt-based professional service. Successful completion depends on factors beyond our control, including but not limited to subject availability, evasive behavior, safety considerations, access limitations, weather conditions, and third-party interference.
Except as expressly stated in Section 5 below, timelines are not guaranteed, and payment does not guarantee successful service.
5. Refund Policy & First-Attempt Guarantee
5.1 First-Attempt Guarantee (In-Service-Area Orders Only)
For orders within Grey Legal Services’ normal service area, Grey Legal Services offers a First-Attempt Timing Guarantee as advertised on our website.
If Grey Legal Services fails to make the first service attempt within the stated timeframe after the order has been accepted, the client will receive a full refund of the base service fee.
An order is considered “accepted” when it has been reviewed, confirmed, and assigned for service by Grey Legal Services.
5.2 Exceptions to the Guarantee
The First-Attempt Guarantee does not apply in any of the following circumstances:

Orders outside Grey Legal Services’ normal service area

Orders requiring outsourcing or subcontracting to third-party providers

Incorrect, incomplete, or misleading address or subject information

Unsafe or restricted access conditions

Refusal of service, evasion, or unavailability of the subject

Delays caused by force majeure or factors beyond reasonable control
Out-of-service-area orders, including those subject to additional fees, are not eligible for the First-Attempt Guarantee.
6. Fees, Payment & Cancellations
Payment is required in full before service begins.
Once service attempts have commenced, all fees are non-refundable, including but not limited to rush, same-day, out-of-area, and add-on service fees.
If an order is canceled prior to any service attempts, a refund may be issued at Grey Legal Services’ discretion, less any work already performed.
Grey Legal Services reserves the right to charge additional fees for services outside the original scope of the order, including additional attempts, stakeouts, or investigative work, with client approval where required.
7. Limitation of Liability
To the maximum extent permitted by law, Grey Legal Services shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of claims, loss of cases, or missed deadlines.
Grey Legal Services’ total liability for any claim arising out of or relating to an order shall not exceed the amount paid by the client for that specific service.
8. Force Majeure
Grey Legal Services shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to unsafe conditions, natural events, governmental actions, refusal of service, or third-party interference.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
